Basing a decision on what is essentially a third-party viewpoint (the employer being the third-party) may not be entirely fair on the employee. It is also imperative that employers be aware of the inadmissible nature of some information which is gathered by certain investigation techniques and are at all times conscious of the legal restrictions and consequences of making decisions based on the information gathered from social media.
